بررسی تحلیلی تدابیر منجر به تألیف قلوب در اسناد بالادستی جمهوری اسلامی ایران

چکیده

هدف: «اصل تالیف قلوب» به‌عنوان آموزه شریف قرآنی و از وظایف حکومت اسلامی در اسناد بالادستی جمهوری اسلامی مورد توجه قرار گرفته که نیاز به بررسی تحلیلی آن است. همچنین بر اساس تحولات اخیر کشور در عرصه داخلی (آشوب‌های سال 1401) و تحولات بین‌المللی (مخصوصاً جنگ نابرابر غزه) ضرورت توجه به این اصل جهت پیشگیری از رویدادهای مشابه بیشتر نمایان است. سؤال آنست که جمهوری اسلامی چه قوانینی را در اسناد بالا دستی تنظیم کرده و چه تدابیری را اندیشیده تا با بررسی تحلیلی و نقد آن علاوه بر مشخص شدن ظرفیت فعلی قانونی و استفاده بهینه از آن، زمینه جهت تکمیل و تقویت آن فراهم آید.
روش‌شناسی پژوهش: روش تحقیق، تحلیل محتوا از نوع کیفی است که پس از یافتن قوانین کلی در حوزه تألیف قلوب، تحلیل و نقد صورت می‌پذیرد.
یافته‌ها: تألیف قلوب گاه با اعطای کمک‌های اقتصادی و گاه با تدابیر فرهنگی یا سیاسی مناسب در روابط داخلی و خارجی نسبت به افراد، جمعیت‌ها و یا مللی که مستحق تألیف هستند و با به‌کارگیری اموری چون صلح، تفاهم، پایبندی به معاهدات، حمایت از نهضت‌های آزادی‌بخش و یا توسعه‌ی صنعت گردشگری و جهانگردی و... انجام می‌شود.
نتیجه‌گیری: موارد فوق از باب تمثیل و نه تعیین در این قوانین آمده است و هم ظرفیت بالای پیشگیری از بسیاری ناگواری‌های داخلی و خارجی را بیان و هم اصل خلاقیت برای کارگزاران را تقویت می‌کند که حتی از نظر قانونی نیاز به منتظر ماندن ورود عناوین و مفاهیم تمثیلی دیگر در نگارش اسناد جدید نباشند.
