جایگاه معاهدات بین‌المللی در حقوق اساسی ایالات ‌متحده آمریکا (بررسی موردی برجام)

چکیده

هدف: هدف مقاله با لحاظ خروج یکجانبه دونالد ترامپ از برجام به‌عنوان یک توافق بین‌المللی، درکنار خروج از توافقنامه منع موشک ‏های هسته ‏ای میان‏برد، توافقنامه پاریس، سازمان بهداشت جهانی، کمیسیون حقوق بشر سازمان ملل، بررسی نسبت میان حقوق داخلی آمریکا و حقوق معاهدات بین ‏الملل و در نتیجه بررسی مبنای حقوقی خروج آن از برخی توافقات از جمله برجام است.
روش ‏شناسی پژوهش: با استفاده از روش تحلیل محتوای حقوق اساسی ایالات متحده آمریکا و در چهارچوب دونظریه حقوقی«مونیسم» و «دوآلیسم»، در صدد است نسبت واقعی حقوق داخلی آمریکا با قواعد حقوق بین‏ الملل را بررسی نماید.
یافته ‏ها: یافته ‏های پژوهش نشان می‏ دهد که نظام حقوقی ایالات متحده هیچ‏ رویه یا عرف قابل ‏پیش ‏بینی در مواجهه با قواعد حقوق بین ‏الملل نداشته و هر بار با توجه به شرایط داخلی و در چهارچوب منافع ملی ایالات متحده، به یکی از دو نظریه مونیسم و دوآلیسم روی آورده است.
نتیجه ‏گیری: همسویی نظام حقوقی ایالات متحده با نظام حقوقی بین‏ المللی و جهانی تا جایی تداوم دارد که موجب تحقق منافع آن کشور شود، یا حداقل در تعارض با منافع آن کشور نباشد. از این ‏رو مسأله‏ ی عضویت واشنگتن در معاهدات بین‌المللی پیچیده است و نمی‌توان آن را پیش‌بینی نمود. نتیجه آن‌که حتی پس از تصویب معاهده و صدور اعلامیه‌ی رییس‌جمهور نیز، نمی‌توان از اجرای قواعد معاهده در نظام حقوق داخلی این کشور اطمینان حاصل نمود.
