ظرفیت‌های مواجهه با فساد سیاسی در حقوق اساسی جمهوری اسلامی ایران در پرتو مؤلفه‌های مردم‌سالاری دینی

چکیده

هدف: در تحقیق حاضر برآنیم تا ظرفیت‌های مواجهه با فساد سیاسی در پرتو مؤلفه‌های مردم‌سالاری دینی از منظر حقوق اساسی جمهوری اسلامی ایران را استخراج و ارائه نماییم
روش ­شناسی پژوهش: نوع پژوهش بنیادی و دارای رویکرد توصیفی- تحلیلی بر مبنای پذیرش نظریه کارکردگرایی است. روش گردآوری مطالب کتابخانه‌ای و تحلیل اصول قانون اساسی، منابع مربوط به حقوق اساسی و فساد سیاسی، فیش‌برداری و تقریر آن‌هاست
یافته­ ها: یافته‌های پژوهش حاکی از آن است که فساد سیاسی به‌مثابه سوءاستفاده از اختیارات قانونی در جهت تحکیم پایه‌های قدرت یکی از اصلی‌ترین عوامل ناکارآمدی، نابودکننده مقبولیت و مشروعیت نظام سیاسی و تهدید کنند حقوق ملت بوده و مبارزه با آن تکلیف عقلی، دینی و تاریخی است. قانون اساسی نیز به‌عنوان قدر متیقّن حقوق اساسی و آخرین سنگر دفاع از حقوق و آزادی‌های ملت، دارای ظرفیت‌های گوناگونی جهت مواجهه با این پدیده شوم است، ازجمله: چارچوب دینی نظام سیاسی، برابری و کرامت ذاتی انسان‌ها، آزادی و مشارکت سیاسی و حاکمیت قانون؛ که تحت عنوان مؤلفه‌های اصلی مردم‌سالاری دینی می‌توان از آن یاد کرد.
نتیجه­ گیری: حقوق اساسی جمهوری اسلامی ایران در پرتو مؤلفه‌های اصلی مردم‌سالاری دینی دارای ظرفیت‌های مهمی جهت مواجهه با فساد سیاسی به‌عنوان یکی از مهم‌ترین عناصر ناکارآمدی است.
